A.F. Construction Company, Inc., (“AFC”) was awarded a contract for the construction of the Clark County Regional Justice Center, located in downtown Las Vegas, Nevada.  The contract for the 18-story, 700,000 square foot Justice Center was originally awarded to AFC in 1999, with a contemplated two-year construction duration.  The project was completed nearly four years late and after Clark County improperly terminated AFC for default.
 
Delta was retained to perform an independent damages analysis of the events and circumstances that impacted AFC’s performance on the project and resulted in significant delay and disruption to the project.
 
Delta worked on the case for a two year period.  The case culminated in a verdict award from a three person Arbitration Panel in December 2008.  The final award, a three-person Arbitration Panel recently awarded A.F. Construction Company, Inc. and its surety, Fireman's Fund Insurance Company, $52.7 million while rejecting virtually Clark County, Nevada’s entire $60 million counterclaim.
