J. Mark Dungan provides consulting services to both the construction and surety industries. Thirty years of involvement in the construction industry has given him an in-depth background in exposure analysis, cost-to-complete, project management, CPM preparation, payment claims analysis, affirmative claims analysis and preparation, and litigation support.
Mark’s experience and expertise has been derived from positions beginning as a field engineer and growing through operations and division managers of the construction division of a multi-billion dollar corporation and a national construction and real estate development company, and finally as an owner of a residential and light commercial construction company. In addition, Mark has been a technical and claims consultant for construction related issues for an international accounting firm. Mark’s expertise is based both on theoretical knowledge and real world experience and, as such, is extremely varied. The value of his work is validated by the fact that he has been sought out by public and private parties to provide project turnaround and completion services, and by both Plaintiffs and Defendants to provide their litigation support and expert testimony.
Selected Project Experience
- Testifying expert in numerous matters involving delay, disruption, cost estimates and construction defects. Projects include a $100 million dollar detention center in Las Vegas with claimed damages in excess of $30 million.
- Directed the take-over and completion of major troubled projects in the United States and Puerto Rico, including highway and bridge projects, public housing projects, municipal and school projects and a power plant.
- Prepared cost-to-complete estimates and exposure analysis for Sureties on several multi-project large loss performance bond claims. Analyzed numerous payment bond claims ranging from routine verification to complex multi-million dollar delay and disruption claims.
- Provided affirmative claim preparation and litigation support for multi-million dollar claims on projects that include a $2 billion pipeline in Mexico, three combined cycle power plants in Argentina and a coal gasification plant in Kansas.
- Provided project management on a $26 million housing project for the US Coast Guard and the modernization of a high-rise government office building.
