GLash3 180x220Gene Lash has over 25 years of experience assisting clients with forensic accounting and economic damage issues. His expertise includes financial fact-finding, forensic accounting, quantification of damages and special purpose audits on a wide variety of commercial and construction related disputes. His commercial experience includes quantifying damages related to breach of contract, breach of fiduciary duty and patent, trade dress and trademark infringement. He has been retained by Fortune 500 companies, closely-held family businesses, internet start-up ventures and insurance companies. His construction experience includes quantifying extra work claims, delay and acceleration claims, disruption claims, lost profit claims and identifying the elements of false claims. His construction clients range from private owners, governmental entities, developers, contractors, sub-contractors, joint ventures, insurance carriers, and architect/engineering firms on a broad range of projects including: airports, casinos, residential, commercial and mixed-use development, hospitals, pipelines, processing plants, power plants, light rail, roadways, bridges, schools and universities. He has testified and presented his findings in both state and federal courts, in AAA and JAMS arbitrations and in various mediations and negotiations. He studied at the University of California at Berkeley where he obtained his Masters of Business Administration and a dual undergraduate degree in Economics and Applied Mathematics. He is a Certified Public Accountant in the State of California and Certified in Financial Forensics. Prior to joining Delta, he was a Director with an international consulting firm and a Senior Manager with a "Big 4" public accounting firm.  He was selected to be in the Who’s Who Legal: Construction 2017 and Who's Who Legal: Consulting Experts - Construction Quantum and Delay 2017.

Representative Experience

  • Testified to over $30 million of damages resulting from the termination for cause of a design build contractor on a Southern California hospital replacement project under OSHPD jurisdiction.
  • Testified to over $30 million of damages resulting from the termination for cause of a design build contractor on a Southern California hospital replacement project under OSHPD jurisdiction.
  • Rebutted testimony on damages sought by a joint venture for unpaid contract balance, disputed change order requests, extended home office overhead and consequential damages, resulting in a favorable jury verdict.
  • Prepared three independent audit reports quantifying unpaid profits resulting from the development of $250 million of single family homes in Southern California, which resulted in a favorable settlement agreement.
  • Quantified damages and losses associated with patent, trade dress or trademark infringement for the following products: video games, rock climbing shoes, designer sunglasses, women's apparel stores, therapeutic hand putty, animal harnesses, and internet computer hardware distribution companies.
  • Prepared an expert report quantifying over $380 million of lost profits and additional costs associated with the failure of a headrace tunnel on a hydroelectric project in Panama, which resulted in a favorable settlement.
  • Assisted an insulation sub-contractor with a successful mediation to resolve over $15 million of delay and disruption damages resulting from partial and late work releases and changes in milestones on the world's largest solar thermal project.
  • Assisted a public agency with the successful resolution of over $10 million of false claims on an international airport in Northern California.
  • Assisted a defense contractor with fact finding and forensic accounting support in the proper valuation of over 20 engineering, procurement and construction (EPC) contracts at issue in a purchase price dispute.
  • Performed peer reviews of construction audits for a large hospital construction program.
  • Reviewed accounting practices and procedures for the Board of Directors a closely held start-up venture.
